Consignment
Naples Gun Shop now offers Consignment Sales for certain firearms. If you'd like to sell your firearm in our large local store, come on in and let's talk. The Consignment Terms are below.
Consignor: Firearm Owner
Consignor agrees to place the item(s) listed on consignment under the terms of this agreement.
Naples Gun Shop (Consignee) agrees to the following:
- Write up the description and specifications necessary to offer the items for sale.
- Offer the items for sale at its Florida location and possibly online nationwide.
- Advertise items as appropriate, including, but not limited to, utilizing an online Broker/Auctioneer at Consignors expense.
- When the items consigned are sold and final payment is made by the final buyer, the Consignor will be sent the net amount by check within 30 days.
- Change the offering price as needed to affect a sale.
- Change the offering price as requested by the Consignor in writing.
The Consignor agrees to the following:
- The Consignor certifies he/she is the legal owner or is authorized by the owner to sell the items. The Consignor warrants that the items listed are free of any encumbrance, free from defects and 100% functional other than customary wear except as noted.
- To grant the exclusive right to Naples Gun Shop to market and sell the items listed.
- That the item(s) consigned will be left on consignment with Consignee for a minimum of 150 days (Florida law requires all consignment items be quarantined for 30 days prior to being offered for sale). Should the Consignor wish to terminate this Agreement, after 150 days a thirty-day (30) written notice of intent to terminate agreement is required. This agreement will continue indefinitely beyond the original 150-day period until a 30-day written notice is received.
- If the Consignor wishes to have consigned items returned, Federal Law requires that the Consignor fill all appropriate forms as if this was a new transfer. This requires the completion of an ATF Form 4473 and the passing of the Florida FES (The Firearms Eligibility System) Background Check. Consignor agrees to pay Naples Gun Shop a $55.00 fee for each item returned.
- If consignor fails FES background check, the firearm becomes the property of Naples Gun Shop to do with as the company wishes, pending the results of the optional official appeal. The Consignor will have 90 calendar days to supply Naples Gun Shop with the original Florida Dept. of Law Enforcement Firearms Purchase Program letter identifying the transfer denial has been converted to an approval.
- It is the Consignor’s duty to keep their phone number, email address and mailing address information up to date with Naples Gun Shop in writing.
- If the item is not picked up by the Consignor within 3 months following a request to do so or Naples Gun Shop is unable to make contact with the Consignor within 12 months of the date of the original consignment agreement, the Consignor hereby relinquishes ownership of and any ownership rights to said item and same item shall be considered abandoned.
- The consignment fee shall be 20% of the final sale price of the item if sold in our pysical store or 29% and a $10 shipping fee if sold online, with a minimum fee of $50 per item. Should the requested selling price exceed $10,000, the consignment fee may be reduced to 12%. Fees for other services provided by Naples Gun Shop, (e.g., cleaning or repair) and/or for services provided by third-party vendors (e.g., online, auction listing and related fees) are additional and are not included in the consignment fee and will be added to any fee due Naples Gun Shop.
- All efforts will be exercised by Naples Gun Shop to mail any payment due after the selling of any consigned item, minus above stated fees & costs. Payment will be by Company Check, mailed to the address on file for the Consignor. If a mailed check is returned for no forwarding address, Naples Gun Shop will attempt phone and email contact. If Naples Gun Shop is unable to make contact with the Consignor after three attempts over 30 days, the payment will be considered forfeited and abandoned.
- Consignee shall not be liable to Consignor for any loss or damage suffered to Consignor's merchandise, including, but limited to, loss or damage to such merchandise from fire, theft, or other casualty. Consignor hereby fully releases Consignee from any and all claims of any nature in connection with or arising from the placement of Consignor's merchandise with Consignee. Consignor further covenants that he/she shall make no claim against Consignee, Consignee’s insurance carrier or the property owner where the items are being stored or held for any damage to Consignor’s merchandise.
- Consignee shall not be liable to Consignor for any loss or damage suffered to Consignor's merchandise, including, but limited to, loss or damage to such merchandise from fire, theft, or other casualty. Consignor hereby fully releases Consignee from any and all claims of any nature in connection with or arising from the placement of Consignor's merchandise with Consignee. Consignor further covenants that he/she shall make no claim against Consignee, Consignee’s insurance carrier or the property owner where the items are being stored or held for any damage to Consignor’s merchandise.
